These Terms of Service govern your use of the Moving To Mars website and any purchases made through it.

Moving To Mars is a trading name of SEMDEV CREATIVE LTD, a company registered in England and Wales under company number 17429628, with its registered office at 20 Wenlock Road, London, England, N1 7GU.

In these Terms, “Moving To Mars”, “we”, “us” and “our” refer to SEMDEV CREATIVE LTD T/A Moving To Mars.

By using our website or placing an order with us, you agree to these Terms.

1. About Our Store

Moving To Mars sells clothing and related products through our online store.

These Terms apply to purchases made through the Moving To Mars website. Additional policies, including our Privacy Policy, Shipping Policy and Returns Policy, also apply where relevant.

If there is a conflict between these Terms and any mandatory rights you have under applicable consumer law, your statutory rights will take priority.

2. Products

We make reasonable efforts to ensure that product descriptions, photographs, measurements and other information displayed on our website are accurate.

However, minor variations may occur between a product and the images or information displayed online.

colour caused by screen settings, lighting or photography;
print colour, texture or finish;
print positioning, alignment or scale;
fabric shade or texture;
garment measurements within normal manufacturing tolerances; and
other minor characteristics resulting from the printing or manufacturing process.

Product photographs are intended to represent the product as accurately as reasonably possible, but your device may display colours differently from the physical product.

These minor variations will not, by themselves, mean that a product is defective or incorrectly supplied.

Nothing in this section permits us to supply a product that is materially different from its description, is not of satisfactory quality, or otherwise fails to meet your statutory consumer rights.

3. Sizing

Sizing information and measurements provided on our website are intended to help you select an appropriate size.

Garment measurements may vary slightly due to normal manufacturing tolerances.

You are responsible for checking the available sizing information before placing your order.

Nothing in this section affects your statutory rights where an item has been incorrectly described, incorrectly supplied or is faulty.

4. Product Availability

All products are subject to availability.

Adding an item to your basket does not reserve it.

We may withdraw products, change availability or limit quantities at any time.

If we are unable to fulfil an order after payment has been taken, we will cancel the affected item or order and refund the relevant amount using the original payment method.

5. Orders

When you place an order, you are making an offer to purchase the products in that order.

After placing an order, you will normally receive an order confirmation. This confirms that we have received your order but does not necessarily mean that we have accepted it.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

a product is unavailable;
pricing or product information contains an obvious error;
we are unable to authorise or verify payment;
we reasonably suspect fraud or misuse;
an order breaches purchase restrictions stated on the website; or
we are unable to fulfil the order for another legitimate reason.

If we cancel an order after taking payment, we will refund the appropriate amount.

You are responsible for ensuring that the information supplied when ordering, including your name, delivery address and contact information, is accurate.

6. Prices and Payment

Prices are displayed on the website in the currency shown at checkout.

The total amount payable, including applicable delivery charges and taxes, will be displayed before you complete your purchase.

We may change our prices at any time. Changes will not affect orders that we have already accepted.

7. Pricing Errors

We try to ensure that all pricing information is correct.

If a product has been listed at an obviously incorrect price due to a technical or administrative error, we are not required to supply the product at that incorrect price where the mistake should reasonably have been apparent.

Where this occurs, we may cancel the affected order and provide a full refund.

8. Delivery

Available delivery methods, estimated delivery times and delivery charges will be shown on our website or during checkout.

Delivery estimates are estimates rather than guaranteed delivery dates unless we expressly state otherwise.

We are not responsible for delays caused by circumstances outside our reasonable control. Where a significant delay occurs, we will provide any rights or remedies required by applicable consumer law.

9. Your Right to Cancel

If you are a consumer purchasing online, you will normally have the legal right to change your mind and cancel your order within 14 days after receiving the goods, subject to any applicable legal exceptions.

You do not need to provide a reason for exercising this statutory cancellation right.

To exercise your right to cancel, you must clearly tell us that you wish to cancel within the applicable cancellation period.

10. Handling Returned Products

You may inspect and handle a product to the extent reasonably necessary to establish its nature, characteristics and functioning, similar to how you might examine it in a physical shop.

Where a returned product has been handled beyond what is reasonably necessary and its value has been reduced as a result, we may make a deduction from the refund where permitted by law.

11. Faulty, Damaged or Incorrect Products

Your statutory rights are separate from your right to change your mind.

Nothing in our refund process affects any mandatory refund rights you have under applicable law.

From time to time, we may offer discount codes, promotional offers or other promotions.

Unless otherwise stated:

promotions cannot be exchanged for cash;
promotional codes must be entered at the appropriate stage of checkout;
promotional offers may have expiry dates or eligibility requirements;

promotional codes cannot be applied retrospectively to completed orders.

We may withdraw or amend a promotion where reasonably necessary, but this will not affect orders already accepted under that promotion.

We may cancel an order or remove a discount where we reasonably believe a promotion has been misused, exploited or obtained fraudulently.

The Moving To Mars website and the materials made available through it, including logos, artwork, graphics, photographs, product designs, text and other content, are owned by or licensed to us unless otherwise stated.

Nothing in these Terms transfers ownership of those rights to you.

You may use the website for your own personal and non-commercial use.

You must not reproduce, distribute, modify, sell, commercially exploit or otherwise use our protected materials without the permission of the relevant rights holder, except where permitted by law.

15. Acceptable Use of Our Website

You must not knowingly:

interfere with the operation or security of our website;
introduce malware, viruses or other harmful material;
attempt to gain unauthorised access to our systems;
use automated systems to scrape or extract website content without permission;
use the website for fraudulent or unlawful purposes; or

Our products are supplied primarily for personal and domestic use. We are not responsible for business losses such as loss of profit, loss of revenue, loss of business or loss of commercial opportunity arising from consumer use of our products, except where liability cannot lawfully be excluded.
